What is CCPA and How Does It Affect You?

The California Consumer Privacy Act (CCPA), was enacted in 2018 and creates new consumer rights relating to the access, deletion, and sharing of personal information collected by businesses. It also requires the Attorney General to solicit broad public participation and adopt regulations for furthering the CCPA’s purposes. The proposed regulations establish procedures to facilitate consumers’ new rights under the CCPA and provide guidance to businesses for compliance.

Does CCPA Apply To Your Business?

CCPA applies to for-profit companies, conducting business in California, that collect California consumers’ personal information or companies which have the information collected on their behalf.  If any of the following criteria is met, CCPA applies to you.

  • Annual gross revenues in excess of 25 million
  • Annually buys, receives for commercial purposes, sells, or shares for commercial purposes personal information relating to 50,000 or more consumers, households, or devices, or
  • Derives 50% or more of its annual revenues from selling consumers’ personal information.

An entity must also comply if it controls or is controlled by a business that meets the above requirements and shares common branding with the entity, such as a shared name, service mark, or trademark.

Even if your business is not based in California, if you do business with Californians and meet any of these criteria, CCPA applies to you.  CCPA becomes effective January 1, 2020.
